T.J. Lane hearing heald in Chardon

(Chardon) - An appeals hearing was held in this morning, examining the sentence handed down to T.J. Lane in the Chardon High School shooting case. The session was conducted at the Geauga County Courthouse.

Judges Timothy Cannon, Cynthia Westcott Rice and Thomas Wright, from the 11th District Court of Appeals heard arguments for and against the appeal for Lane who shot and killed three students at the school 2 years ago.

Lane was 17 when the crimes were committed, and was sentenced last year to three life terms without parole after pleading guilty.

Appellate attorney Michael Partlow claims Lane should have been eligible for parole because he was a juvenile.

Geauga County Prosecutor James Flaiz contends Lane's age was taken into account by the judge, and it was decided that youth was not a factor since Lane methodically planned and conducted a complex attack on the high school.

It could be several weeks, or even months before a decision is made on Lane's appeal.

In a different juvenile murder case, the Ohio Supreme Court ruled earlier that a trial court must reconsider the sentence of life without parole that was handed down.
